Lincoln Road Planning Agreement - Deed of Assumption and Variation

Council has received an offer from Town Beach Pty Ltd as trustee for Randale Pty Ltd Superannuation Fund (New Landowner) to enter into a Deed of Assumption and Variation in connection with the Lincoln Road Planning Agreement. The New Landowner has made an application to modify Development Consent granted to DA2017-870 for subdivision of the land to which the planning agreement applies.

The Lincoln Road Planning Agreement was entered into between Council and the former owners of the Land on 1 August 2017 in connection with proposed change to the zoning of the land. The amendment to the Local Environmental Plan took effect on 13 October 2017.

The planning agreement applies to Lot 1 DP 1066820 Lincoln Road, Port Macquarie and Lot 34 DP 856163 Castle Court, Port Macquarie and provides for:

  • The transfer of Council owned land to the New Landowner, being part of Lot 34 DP856163,
  • The establishment, dedication to Council and management of environmentally sensitive land in conjunction with residential subdivision of the land,
  • Improvements to and reallocation of stormwater infrastructure into Council ownership.

The proposed variations relate to the assumption of the rights and obligations by the New Landowner and changes to the timing of dedication of Environmental Land, granting of an easement and construction of stormwater works to reflect the proposed modified development that introduces stages.

Any person may inspect the agreement and make a written submission until close of business on Wednesday 27 November 2019.
