Consultation on this development proposal has concluded

Council is proposing to amend the Local Environmental Plan (LEP) 2011 to rezone land at Fernbank Creek Road, Fernbank Creek from Primary Production (RU1) to part Tourist (SP3) and part Environmental management (E3).

The purpose of proposed rezoning is to create a tourist-orientated special purpose zone, complimentary to the existing winery.

    Following on from community consultation, a report was presented to Council on Wednesday 20 August. Below is the outcome of this report. To read a copy of the report, click here.

    Item 13.08 PLANNING PROPOSAL TO REZONE LAND AT FERNBANK CREEK FOR TOURISM AND ENVIRONMENTAL MANAGEMENT

    • Mr John Ross OAM, Hastings Estate Pty Ltd, addressed Council in support of the recommendation and answered questions from Councillors.
    • Mr Scott Marchant, King and Campbell Pty Ltd, on behalf of the landowner, addressed Council in support of the recommendation.

    RESOLVED: Turner/Sargeant

    That Council:

    1. Endorse the draft Local Environmental Plan amendment as described in the report.

    2. Take the necessary steps under Sections 58 and 59 of the Environmental Planning and Assessment Act 1979 to finalise Local Environmental Plan 2011 (Amendment No 24) as attached to the report.

    3. Enter into the Hastings Estate and Koch Planning Agreement relating to Lot 1 Deposited Plan 222740, Lot 229 Deposited Plan 754434 and Lot 1 Deposited Plan 318920, Fernbank Creek Road, Fernbank Creek.

    4. Write to those who made a submission to the proposal to thank them for their contribution and provide information on Council’s decision.

    Council has received an offer to enter into a voluntary planning agreement to restrict development of the land until the Pacific Highway deviation has been completed, or until Sancrox Road intersection has been upgraded.

    The Planning Agreement will provide for:
    • planting of koala food trees
    • payment of monetary development contributions
    • provision of water supply and sewerage services
    • upgrading of Fernbank Creek Road in conjunction with development of the land

    No decision has been made about the final outcome of the proposal. All documents on display are draft documents for consultation purposes only and are yet to be considered by Council.

    Information may be inspected at Council’s Port Macquarie, Wauchope and Laurieton offices between 8:30am and 4:30pm on normal business weekdays until the end of the notification period on Monday 4 August 2014.

The proposed amendment to Council’s planning controls will change the zone of the nominated sites from rural to special purpose tourist and environmental management.

    Preparation of the Planning Proposal is consistent with the key implementation actions identified in Port Macquarie-Hastings Council’s local growth plan; Port Macquarie-Hastings Urban Growth Management Strategy 2011-2031.

    Port Macquarie-Hastings Council and the NSW Department of Planning, and Infrastructure, will assess the proposal and, subject to consultation with state agencies, the planning proposal forms the basis for public participation in the proposed LEP amendment.

    A Gateway Determination, allowing the Planning Proposal to proceed has been issued by the NSW government. A copy of the Determination is included in the community engagement material for public exhibition.
