Consultation has concluded

The Crown Land Management Act 2016 (the CLM Act) authorises councils appointed to managed dedicated or reserved Crown land as Crown Land Managers. This allows councils to manage the Crown land as if it were public land under the Local Government Act 1993 (LG Act). Under the LG Act a Plan of Management (POM) must be adopted by Council for all land classified as ‘community’ land that council manages.

The draft POM was reported to Council in November 2021, when it was resolved to proceed to submit the draft POM to Crown Lands for endorsement. The draft POM was submitted to Crown Lands in November 2021. Crown Lands have now completed reviewing the draft POM and on 6 March 2023 Council received endorsement to proceed to public exhibition of the draft POM. Following the closure of the exhibition period, Council will review the submissions and will report back to Council for formal adoption of the POM.

Background

Council manages a total 146 Crown reserves over hundreds of parcels of land.

The Department of Planning and Environment - Crown Lands, have confirmed the classification of 69 Crown reserves as ‘community’ land and 16 reserves as ‘operational’ land. All the community classified reserves have been included in the draft POM. There are also 61 Crown reserves that have been devolved to Council to managed, that are not required to be included in the POM.

This is the first time the reserves have been included in a POM under the LG Act. The POM addresses the current development and use of the land and establishes directions for future management and use of these important public resources to meet the diverse needs of the community. The POM also authorises Council to renew and enter into future leases and licences when certain conditions can be met.

The POM has drawn upon all previously consulted and adopted Council documents including the Community Strategic Plan, Operational Plan, Delivery Program, Masterplans, Strategic Plans and the 14 adopted local area Community Plans. The POM seeks to align with proposals and directions that have already been adopted by Council.

Key Points

  • The Department of Crown Lands directs the process for the preparation and adoption all POMs by NSW Councils.
  • The draft POM does not propose any new plans, strategies and agreements relating to the Crown land we manage - it is a compilation of all previously consulted and adopted ones.
  • The draft POM originally contained 71 Crown reserves - Department of Crown Lands revised this down to 69 (2 reserves being classified as operational land and not required to be included in the POM).
  • There will be some minor changes / updates required to the draft POM due to the time lapse between submission of the draft to Crown Lands in November 2021 and receiving their endorsement in March 2023.
  • Any new proposed strategy and/or plan et al will continue to be publicly consulted through the usual process, formally adopted by Council and then included in an updated future POM/s.

The draft PoM will be on exhibition for 28 days and submissions will be accepted for 42 days. Submissions can be made by:

  • Reviewing the Council report and resolution 3.11.2021
  • Completing the submission form below
