Council has received an offer to enter into a Planning Agreement known as the Draft DA2024/249 Batar Creek Road Planning Agreement, between Council and Allam MHE Developments No. 2 Pty Ltd. This draft planning agreement applies to Development Application DA2024/249 lodged with Council on 7 May 2024 in respect to Lot 101 DP 1288830 and Lot 201 DP 1302665.

Purpose

The intent of the draft planning agreement is to:

  • Carry out and complete the upgrade to part of Batar Creek Road to a rural collector standard in association with the manufactured home estate under Development Application DA2024/249.
  • Mandate the development contribution credit associated with the construction of Batar Creek Road, associated with Development Application DA2024/249 and Development Application DA2017/736.
  • Allow offsets against specified monetary development contributions taking into account the material public benefit provided to Council by the Developer under the agreement.
  • Impose obligation to the Developer regarding the execution of specified works, and the rectification of any defects in those works.
  • Require the Developer to provide security for legal costs to Council, should it need to enforce the terms of the agreement.
  • Require the agreement to be registered on the title of the land.

During the public exhibition period, all interested persons are encouraged to view the draft agreement and provide written comments.
