Council has received an offer from Gwynvill Trading Pty Ltd to consolidate two existing Planning Agreements into a single Planning Agreement. These agreements include:
- The Ocean Club Residential Community Planning Agreement, executed on 23 December 2011; and
- The Tolone Area 14 Stage 1A Planning Agreement, executed on 23 December 2011.
The Planning Agreement letter of offer relates to the following Development Consents being: DA 2007/620, DA 2013/709 and DA 2017/1057.
In total the development seeks to deliver 419 manufactured dwellings in stages across the land.
Purpose
The objective of the draft Planning Agreement is to provide suitable funding for provision of infrastructure, facilities and services to meet the Development on the Land, the carrying out of intersection works at Ocean Drive, dedication of land for road widening purposes, the ongoing maintenance of private sewerage infrastructure, and the establishment, management and dedication of environmental management land.
The key provisions of the draft Planning Agreement include the following:
- requires monetary Development Contributions of a specified minimum for water supply, roads, sewerage, open space, environmental land, community facilities and administration purposes
- requires the carrying out of specified Works by the Landowner for the purposes of environmental land and an Ocean Drive intersection
- requires the dedication of specified land to Council by the Landowner of environmental land and for the Ocean Drive Road Widening
- requires the ongoing management of private sewerage infrastructure by the Landowner
- requires Council to apply monetary Development Contributions made under the Agreement towards the specified purpose for which they were made and at the location, in the manner and to the standard (if any) specified in the Agreement
- imposes obligations on the Landowner in relation to the carrying out of specified Works, the handing over of those Works to Council and the rectification of defects in those Works
- requires the Landowner to provide Council with Security relating to the satisfactory completion of specified Works required to be carried out by the Landowner under the Agreement.
Notice is also given of the revocation of the Ocean Club Residential Community Planning Agreement and the Tolone Area 14 Stage 1A Planning Agreement.
